General terms and conditions of sale

Article 2 – Purpose
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which Make Up Sway.M provides event makeup services, including but not limited to weddings, ceremonies, parties, photo shoots, private events, or any other aesthetic service.
Any booking implies full and unconditional acceptance by the Client of these General Terms and Conditions.
Article 3 – Services
The services offered by Make Up Sway.M are described on the website, communication materials, and quotations sent to the Client.
Each service is personalized according to the Client’s needs and expectations.
Make Up Sway.M reserves the right to refuse or interrupt a service if hygiene, safety, respect, or feasibility conditions are not met.
Article 4 – Prices
Prices are expressed in euros (€), all taxes included.
VAT not applicable – Article 293B of the French General Tax Code.
Prices do not include travel, accommodation, or logistical expenses.
For any wedding-related service, a minimum amount of €500 is required.
Make Up Sway.M reserves the right to modify its prices at any time. However, the price applied will be the one in force at the time the booking is confirmed.
Article 5 – Booking
The booking becomes final and binding after:

written validation of the quotation (by email), and
-
where applicable, payment of a deposit equal to 30% of the total amount.
In the absence of deposit payment, Make Up Sway.M reserves the right to cancel the booking without prior notice.
Article 6 – Payment Terms
Payments may be made by:
-
bank transfer,
-
cash (under certain conditions).
The remaining balance of the service must be paid one month before the event date, unless an exceptional prior agreement has been made.
Any late payment will result, without prior formal notice, in:
-
a fixed penalty of €40, and
-
an additional charge of 15% of the total amount per day of delay.
Article 7 – Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, services related to a specific date or event are not subject to the right of withdrawal.
Article 8 – Cancellation
Cancellation by the Client
Any cancellation must be notified in writing. In the event of cancellation by the Client, no refund shall be due.
Cancellation by Make Up Sway.M
In the event of force majeure or circumstances beyond its control, Make Up Sway.M undertakes to inform the Client as soon as possible and to offer a partial refund, full refund, or rescheduling, depending on the situation.
In the event of cancellation of the event for legal, regulatory, or administrative reasons, a refund of 50% of the amounts paid will be applied.
Article 9 – Liability
The Client agrees to inform Make Up Sway.M, prior to any service, of any known allergies, skin sensitivities, medical conditions, or dermatological issues.
In the absence of such information, Make Up Sway.M cannot be held responsible for any skin reaction or discomfort occurring after the service.
Article 10 – Hygiene, Equipment, and Safety
Make Up Sway.M works exclusively with professional equipment, which is cleaned and disinfected between each Client, in compliance with applicable hygiene regulations.
The Client agrees to provide a suitable workspace including at minimum: a chair, a flat surface, access to a functional electrical outlet, and sufficient lighting, ideally natural light.
All equipment used remains the exclusive property of Make Up Sway.M.
Any loss, breakage, theft, or damage may be charged to the responsible Client.
If the Client or any person present has a contagious condition or behaves in a manner that compromises hygiene or safety, Make Up Sway.M reserves the right to immediately stop the service without any refund.
Children must be supervised at all times by a responsible adult. Any incident or accident involving a minor in the workspace cannot be attributed to Make Up Sway.M.
Article 11 – Event Day Procedure
Make Up Sway.M arrives at the service location approximately 15 minutes before the scheduled time in order to set up equipment.
The Client agrees to ensure free, smooth, and punctual access to the designated workspace.
In the event of a delay attributable to the Client, additional fees may apply:

delay exceeding 30 minutes: €50,
-
delay exceeding 1 hour: €100.
Any request for a complete change of makeup or hairstyle during the day will be considered a new service and charged accordingly.
Article 12 – Intellectual Property
All content on the Make Up Sway.M website and communication materials (texts, images, photographs, logos, visuals) is protected by intellectual property law.
Any reproduction, distribution, or use without prior written authorization is strictly prohibited.
Article 13 – Image Rights
The Client expressly authorizes Make Up Sway.M to use photographs and videos taken during services for communication and promotional purposes (website, social media, advertising materials, portfolios, professional publications, etc.).
This authorization applies only to content created by Make Up Sway.M as part of the services, with no limitation in time or territory, unless otherwise expressly stated by the Client.
The Client may request that their image or that of certain guests not be used by submitting a written request to Make Up Sway.M prior to the service.
In such cases, Make Up Sway.M agrees to respect this request to the extent possible.
Article 14 – Personal Data
Personal data collected is used exclusively within the framework of the commercial relationship between the Client and Make Up Sway.M.
In accordance with applicable regulations (GDPR), the Client has the right to access, modify, and delete their personal data upon simple request.
Article 15 – Modification of Terms
These General Terms and Conditions of Sale may be modified at any time.
The new conditions will apply only to bookings made after they are published online.
Article 16 – Acceptance
Validation of the quotation and/or signing of the contract constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
Article 17 – Disputes
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority before any legal action.
